Government officers make exclusive address on 'Payments Act'

8 Jul 2008

Two of Australia’s key State Government officers who administer the building industry’s most important legislation in NSW and QLD – the Building and Construction Industry Security of Payments Act (‘the Act’) will be addressing industry members exclusively at a workshop in July.
Builders struggling with the impact of the construction downturn can learn how to save money and reduce their risk by improving their understanding of the law. Presented by Scott Pettersson, ex-Chief Executive Officer of LEADR and senior adjudicator, the Protect Your Payments workshop will explain the importance of the Building and Construction Industry Security of Payments Act (‘the Act’) in determining who owes what to whom in a construction project.
Mr Michael Chesterman, Registrar of the Building and Construction Industry Payments Agency in Queensland and Mr Matthew Gissane, the officer responsible for the administration of the Building and Construction Industry Payments Act in the NSW Department of Commerce, will be addressing delegates in Brisbane and Sydney respectively about the Government’s perspective on the current state and role of the Act in the industry.
Endorsed by the Australian Institute of Building, the purpose of the workshop is to educate businesses in the Building and Construction industry on the proper use and implementation of the Act,  which is the simplest, fastest and most-cost effective process available to determine who owes what and to whom in a construction project.
Mr Pettersson is surprised that the take-up of the Act is limited and finds that it is largely misunderstood. “Adjudication costs are a fraction of a full blown contested litigation and can be a useful mechanism for keeping construction flowing and reduce costs to the end users,” he said.
The workshop is being held in Brisbane on 15 July and Sydney on 24 July. Kite Events & Conferences , which specialises in delivering professional development events for the building construction, property and related industries across Australia is hosting the workshop
Kite Director, Shuba Paheerathan, said as inflation rises and the economy starts to decline, property and construction is invariably one of the first industries to be hit by the effect of reduced investment.
“This affects the cash flow of contractors, sub-contractors, suppliers of materials and equipment and consultants to the building project. The Act can help with this.  Many businesses know the Act is there, but don’t realise they are not using it properly.. Implementing the Act incorrectly can actually endanger your claim when you need it most,” She explained.
This workshop is recognised by Engineers Australia for the purpose of continuing professional development and the Royal Australian Institute of Architects is also recommending it to members on its website.
